General Terms and Conditions (AGB) of UBannerz.com

§ 1 Scope and Provider

(1) These General Terms and Conditions (hereinafter "GTC") regulate the sale of products by

(2) Deviating terms and conditions of the customer are rejected.
(3) By placing an order with UBannerz.com, you agree to these terms.
(4) UBannerz.com offers, among other things, individually manufactured products, banners and advertising materials.

§ 2 Conclusion of Contract

(1) Contracts can only be concluded in English.
(2) Offers are directed to customers worldwide, subject to restrictions on certain bulky goods.
(3) The customer must be at least 18 years old.
(4) The presentation of goods in the online shop is not a legally binding offer, but an invitation to submit an offer.
(5) By completing the order process and clicking on “order with obligation to pay”, the customer makes a binding purchase offer.
(6) The contract is concluded only upon confirmation of dispatch or delivery of the goods by UBannerz.com.

§ 3 Prices and Shipping Costs

(1) All prices include the applicable VAT. Shipping costs are shown separately.
(2) The applicable prices are those valid at the time of ordering.

§ 4 Delivery and Cancellation

(1) Delivery is made to the address specified by the customer. Delivery times are non-binding unless explicitly confirmed.
(2) If an item is unavailable, the customer will be informed.
(3) If delivery is not possible because the customer cannot be found at the delivery address or the goods cannot be delivered, the customer bears the costs.
(4) Delivery is made after payment is received (prepayment) or after order confirmation (PayPal or credit card).

§ 5 Customs

(1) Deliveries outside the EU may be subject to customs duties and fees payable by the customer.
(2) The customer acts as the importer and must comply with the applicable laws of the destination country.

§ 6 Payment

(1) Payment methods available:

Prepayment (bank transfer)
Credit card

(2) Cash or cheque payments are not accepted.
(3) For prepayment, the invoice amount must be paid within 5 business days.

§ 7 Set-off and Right of Retention

The right of set-off or retention is only available if the counterclaim is legally established or undisputed.

§ 8 Retention of Title

The goods remain the property of UBannerz.com until full payment is received.

§ 9 Transport Damage

Visible transport damage must be reported immediately. Failure to report does not affect statutory warranty rights.

§ 10 Warranty

Statutory warranty rights under German law apply.

§ 11 Limitation of Liability

(1) UBannerz.com is liable without limitation for intent, gross negligence, injury to life, body or health.
(2) In the case of slight negligence, liability is limited to foreseeable, contract-typical damages and only for essential contractual obligations.

§ 12 Right of Withdrawal

(1) Consumers have a statutory right of withdrawal of 14 days.
(2) Exclusion of withdrawal right: The right of withdrawal does not apply to goods manufactured to customer specifications or clearly tailored to personal needs.

§ 15 Jurisdiction and Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Place of jurisdiction – as far as legally permissible – is the registered office of UBannerz.com.

§ 16 Final Provisions

(1) Contract language is English.
(2) Changes to these GTC remain reserved. The version valid at the time of order applies.
(3) Should any provision be invalid, the validity of the remaining provisions remains unaffected.
